It's an indie game so they don't have to worry about publishers or the ESRB. They can do whatever they want (as long as it doesn't violate Steam's TOS).

That said, $400k seems a bit light for both a single-player and multiplayer game. Multiplayer alone is a costly endeavor, what with all the networking and testing involved. If Stainless wants to generate more revenue, they really should put the Carmageddon games up on GOG and any other digital distributors that are willing to sell it.

From the sounds of their pitch, it sounds like they're confident in their ability to finish the project regardless of whether the Kickstarter is funded, they just decided they would do a Kickstarter as a glorified pre-order in order to get better interaction from the fan community.
