Seems to me that in this case with UMG that if they have an agreement with Youtube than they can excercise it. Youtube is, afterall, a private company and has no obligation to post anything if its so inclined. Besides, there's so much crap on Youtube now and you're basically forced to watch an ad to see anything that the servic is killing itself anyway.
