Yes they are. Maybe they aren't getting it early enough for your taste but that's a different matter entirely.

People who paid got taken for a ride, people who didn't got to keep their $40 and everyone gets the game one the release date.

No one got taken for a ride. People might be disappointed by the promotion and that's their perogative but calling it a scam is just absurd.
