Perhaps they've lost 5,000 sales due to their DRM, but gained 250,000 due to it not being available to pirate. It's not like people are going to post here "well they got my money for once because I was going to torrent Splinter Cell but couldn't, I had to pay for it." I doubt this is the case, but I've no doubt it's the case they'd put forward. It's not much of a case at all, considering that Conviction has been cracked and available on torrents for quite some time, just like AC2, Settlers 7 and Silent Hunter 5.
