I read something on Digg about this a while back and there is apparently some confusion as to whether this is the older console titles or the price of new titles developed for the Virtual Console.

I read something like that too, stating that this pricing would be for new titles (similar to Geometry Wars for the 360). Then again, I wouldn't bitch about these prices; I can think of a few SNES and N64 games that would be well worth $8.99.
