The Witcher 2 Website has word that the promised patch is delayed for The Witcher 2, the just-released action/RPG sequel: The good news is that the patch is ready. The bad news is that we have encountered some problems with the server infrastructure, making downloading DLCs impossible. We want to apologize to our fans for not meeting our target of delivering the patch last night. We will update you when we know more.

Both games are DRM free unless you are using Steam. I am only talking about the Witcher 1, retail version, which is only DRM free AFTER the patches. Unfortunately you have to install those first, which brings us to:
from Krowen:
Server infrastructure to deliver patches has nothing to with DRM.
for The Witcher 1, it does. The patches(for the retail DVD version), which ironically remove the DRM, will NOT INSTALL unless you register the game, which you cannot do, since the servers are down. You cannot even prove you already registered the game(which I did years ago) because the servers are down. As of 5/26/2011, they are still down, unless something else is corrupt at this point. Can't really ask anywhere, as their(CD Projekt) forums are down also.
I bought The Witcher 2 through gog.com, and have had no problems aside from the DLC being undownloadable earlier, due to swamped servers it seems.
However I was attempting to finish up the Witcher 1 first, since as soon as I started TW2 it was apparent that to get everything out of the story, I should have finished TW1.
