, or whether they have failed to live up to the conditions that would allow them to do so. Word is Bethesda has filed what's called a motion in limine
, saying a source tells them "Bethesda is trying to prevent Interplay from bringing damning evidence up in the jury trial." Here's the legalese:
For the reasons set forth in the accompanying memorandum, Bethesda moves the Court for an order:
(1) Holding that Defendant/Counter-Plaintiff Interplay Entertainment Corp. (“Interplay”) bears the burden of proof at trial on each of the following issues: (a) that Interplay has a trademark and copyright license; (b) that Interplay had commenced “full-scale development of its FALLOUT MMOG” by April 4, 2009 as set forth in Section 2.3 of the Trademark License Agreement entered into by Bethesda and Interplay on April 4, 2007 (the “TLA”); and (c) that Interplay had “secured financing for the FALLOUT MMOG in an amount no less than US$30,000,000.00” by April 4, 2009 as set forth in Section 2.3 of the TLA;
(2) Precluding Interplay from offering parol evidence to support its defense that the TLA granted Interplay a copyright license;
(3) Precluding Interplay from arguing at trial that it had satisfied the “full-scale development” and “Minimum Financing” requirements set forth in Section 2.3 of the TLA by April 4, 2009; and
(4) Precluding Interplay from amending its pleadings to assert the affirmative defense of mistake.

, specifying an incident where the player stabs a rat with a combat knife. They mention the (according to our translation) "brutalizing" effect this can have on the game's "young male target audience" (Battlefield 3 is rating USK 18 in Germany), and note that cruelty to animals has been shown to lead to violence toward people. currently offer the following message: "The Steam Forums are temporarily offline for maintenance. Your patience is appreciated." This may be just normal maintenance, but we have also seen an image suggesting they were compromised in some manner, and for a while were directing users to a site offering ways to cheat at games, so this may be what Valve is in the process of cleaning up. . This is in part because it will also mark the sandbox game's departure from beta and the release of version 1.0, which means reviews will start appearing. The game has already sold over four million units(!), and this also means that just 10 days remain to get the game at a 25% prerelease discount. Here's word:
It does feel like the game has already proven itself. Lots of people play the game, and we receive a lot of friendly and positive emails from players. We’ve won several amazing awards, so several people in the industry seems to enjoy what we’ve done. Now it’s just the press left.
It’s a bit weird, but gaming scores have become so big and bloated, I can’t help but feel like I would be disappointed with a score that would be a great score for something like a movie or a music album. And even if the score means relatively little compared to the players and the awards, it’s a distinct number people will use to compare the game to other games.
But what REALLY makes me nervous is the fact that I’m going to have to do at least some public speaking at MineCon. I’m fine with meeting fans and signing stuff, and even with having my picture taken, but standing on stage and trying to get a point across really terrifies me.

I guess there's a certain synchronicity on this site, as there are a couple of comments in the forums from people who had pizza last night, which is odd because that's what we had for dinner in the BlueTower (odd because MrsBlue is one of the few people I know who is meh about this magnificent food, but she had an urge). What was weird is that when we got home we discovered the pizza was square, not a Sicilian-style pie, but rather what the receipt described as "traditional square," which neither of us had ever heard of before. This was sliced like a tic-tac-toe board, which left four corners which were almost entirely crust, four rectangles with crust on one end that oozed insides all over when you bit into them, and a huge center piece with no crust at all that would need to be eaten with a knife and fork. This all seemed a good demonstration of why pizza pies are usually round.
